Terms & Conditions

1. Parties to This Agreement

This agreement is entered into between Baby Panda Studio, operated by Gehad Telb, located at Damac Hills 2, Dubai, United Arab Emirates ("the Studio", "we", "us") and the client ("you", "the Client") who completes the booking form on this website.

2. Photography & Media Release Consent

By booking a session, you — as the parent or legal guardian of the child(ren) being photographed — hereby grant Baby Panda Studio and its photographer Gehad Telb a perpetual, worldwide, royalty-free licence to:

• Photograph and capture images and video of your child(ren) during the session
• Edit, retouch, composite, and creatively process all captured images
• Use, display, publish, and share session photographs on Baby Panda Studio's official Instagram, Facebook, TikTok, and any other social media channels operated by the Studio
• Use session photographs on the Studio's official website (babypandastudio.com) including portfolio, gallery, and testimonial sections
• Use session photographs in printed promotional materials including but not limited to brochures, banners, exhibition displays, and studio décor
• Use session photographs in paid and organic advertising campaigns promoting Baby Panda Studio's services
• Submit session photographs to professional photography awards, competitions, and industry publications for recognition purposes

3. Opt-Out of Media Use

You have the right to opt out of all promotional use of your session photographs at any time by sending a written request to info@babypandastudio.com. Upon receipt, we will remove all identifiable images from our public channels within 14 working days. Opting out does not affect the delivery of your own session photographs and does not entitle you to a refund. This right is honoured in full compliance with UAE Federal Decree-Law No. 45 of 2021 (PDPL).

4. Booking, Deposits & Payment

• All sessions require a non-refundable booking deposit of 30% of the total package price to secure your session date
• The remaining balance is due on the day of the session, prior to the session commencing
• Prices are quoted in UAE Dirhams (AED) and are exclusive of VAT
• VAT will be charged at the applicable rate in force at the time of the session
• All payments must be made in AED by bank transfer, cash, or agreed payment method
• Baby Panda Studio reserves the right to update pricing at any time; confirmed bookings are honoured at the price agreed at time of booking

5. Cancellation & Rescheduling Policy

• Cancellations made more than 7 days before the session: the deposit is forfeited; no further charges apply
• Cancellations made within 7 days of the session: the full session fee becomes payable
• One complimentary reschedule is permitted with a minimum of 72 hours' notice, subject to availability
• Rescheduling with less than 72 hours' notice will be treated as a cancellation unless the cause is a documented medical emergency
• In the rare event that Baby Panda Studio must cancel a session, the deposit will be refunded in full and the Client will be offered a priority rescheduled date
• Newborn sessions may be rescheduled once without penalty if the baby arrives outside the expected due date window

6. Session Conduct & Studio Policies

• Sessions must begin at the agreed scheduled time. Arriving more than 20 minutes late may result in a shortened session with no reduction in fee
• The Studio environment must be kept calm and quiet during all newborn sessions for the safety and comfort of the baby
• All props, wraps, and equipment are the property of Baby Panda Studio and must not be removed from the premises
• Baby Panda Studio reserves the right to stop a session immediately if it believes the safety of the baby is at risk
• Clients are responsible for ensuring children are appropriately fed and rested before arriving
• The photographer has full creative control over all setups, poses, lighting, and editing style

7. Delivery of Photographs

• Fully retouched digital photographs will be delivered via a private, secure online gallery within 4–6 weeks of the session date
• The number of delivered images is as specified in your chosen package
• Raw, unedited, or rejected images are not provided under any circumstances
• Physical products (albums, prints) will be delivered within 6–8 weeks of session date
• The private gallery download link is valid for 30 days from delivery; the Client is responsible for downloading and backing up all images within this period

8. Copyright & Intellectual Property

UAE Federal Law No. 7 of 2002 on Copyright and Related Rights

All photographs produced during a Baby Panda Studio session are the intellectual property and copyright of Baby Panda Studio and Gehad Telb. The Client receives a personal, non-exclusive, non-transferable licence to use delivered photographs for personal purposes only.

• Session photographs may not be sold, licensed, or used for commercial purposes by the Client without prior written consent
• Session photographs may not be altered or watermarked by the Client in a way that misrepresents the photographer's work
• The Client must credit @dubainewborncakesmashstudio when sharing images on social media

9. Personal Data Protection

UAE Federal Decree-Law No. 45 of 2021 (PDPL)

Baby Panda Studio collects and processes personal data for the purposes of booking management, session delivery, and promotional use (where consent has been given). Your data will never be sold or transferred to third parties for marketing purposes. You have the right to request access to, correction of, or deletion of your personal data at any time by emailing info@babypandastudio.com. Data is retained for a maximum of 3 years from your last session date.

10. Governing Law & Dispute Resolution

These Terms & Conditions are governed by the laws of the United Arab Emirates. Any dispute shall first be referred to mediation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

11. Amendments

Baby Panda Studio reserves the right to update these Terms & Conditions at any time. The version in force at the time of booking applies to that booking.
